    The Data Processor possesses the requisites of experience, ability and reliability to implement adequate technical and organizational measures and to carry out the role of external data processor on behalf of the Data Controller.

    Enzo Barone remains responsible for the processing of customer data and never, under any circumstances, the owner, for a limited period and exclusively when interacting directly with the customer’s data and only by means of an express request for action by the same.

    The Manager will be required to:

    • process the data in compliance with the principles of data processing provided for in the GDPR and only for the purposes indicated in the Contract or, better, in relation to the specific intervention carried out on behalf of the Customer;
    • process the data according to the indications received from the Data Controller;
    • ensure that the authorized persons of its structure for the processing of personal data have formally committed themselves to confidentiality or have an adequate legal obligation of confidentiality and have received the necessary training in the field of personal data protection;
    • taking into account the state of the art and the costs of implementation, as well as the nature, object, context and purpose of the processing, as well as the risk of varying probability and gravity for the rights and freedoms of individuals, to put adequate technical and organizational measures are in place to ensure a level of security appropriate to the risk, in particular against:
      1. destruction, loss, modification, unauthorized disclosure, accidentally or illegally, of personal data transmitted, stored and otherwise processed;
      2. data processing not allowed and not in accordance with the purposes of the processing operations;
    • promptly inform and involve the Data Controller of all matters relating to the processing of personal data and, in particular, in the case of requests for information, checks, inspections and accesses by the supervisory authority;

    • immediately inform the Data Controller if his instruction violates, in his opinion, the GDPR, taking into account the nature of the processing and the information available to the Data Processor, and in particular collaborating in the communications of personal data violations, in the fulfillment of the impact assessment and preventive consultations.

    The Manager, if he deems it appropriate, could resort to a sub-manager of the treatment.

     

    In any case, Carni Barone will never be held responsible if due to negligence on the part of the Customer, following official information mail or system application www.carnibarone.it regarding the area of security, there will be no feedback and/or acceptance of related technical intervention by the Customer, all in order to compensate for any flaws that may arise in its system, whether IT or not. For example, if a communication is made to recommend the costly installation of an SSL protocol for your website and the Customer ignores this dedicated information, Carni Barone will not be held responsible for any loss of data or related damage.

     

    AUTOMATED DECISION-MAKING PROCEDURES
